Pirate Prodigy Terms & Conditions.

  1. Pirate
    1. The promoter of this competition is: Pirate Studios Ltd, 3rd Floor, 2-4 Tottenham Road, London, N1 4BZ (“Pirate”, “we”, “us”).
  2. The competition
    1. The title of the competition is Pirate Prodigies. It is a talent search for artists or groups that are users of Pirate Studios Limited website (https://www.piratestudios.co.uk) with the winner gaining access to the prizes as set out below.
    2. There are three rounds of the competition:
      • Round One: To enter round one you must submit an original, recorded song written by you to Pirate via the Pirate website or the following email address [prodigy@piratestudios.co.uk](the “Submitted Song”). The Submitted Songs which are received by the Closing Date (as defined below) will be judged by a judging panel which shall include one independent member. The panel will choose their top 20 Submitted Songs (the “Top20 Submitted Songs”) and the entrants that submitted those 20 Submitted Songs shall be entered into round two.
      • Round Two: The Top 20 Submitted Songs will then be judged by an independent panel of two music industry judges choosing 4 finalists and also the general public who will vote to choose a further 2 finalists, totalling 6 finalists.
      • Round Three: The six finalists shall be invited to attend an audition at Pirate Studios London studio (17 Lydden Road, London, SW18 4LT) where they will perform live and the performance will be filmed and recorded by Pirate. An independent panel shall then choose three winners based on their performance at the audition.
    3. By entering the competition you acknowledge that the purpose of the competition is the search for three winners and the competition will require that you provide recordings of musical and/or vocal performances and if you successfully progress to the third round your musical and/or vocal performances will be recorded.
    4. In the event that you are invited to attend an audition you hereby irrevocably grant all consents necessary for Pirate to film and record such audition, interviews and “behind the scenes” footage and to use recordings featuring your contribution, including without limitation your image and/or voice , in connection with publicity for the Pirate Prodigies competition.
    5. Applications made on behalf of a group must have the consent of all members of the group before applying (and their agreement to an acceptance of these terms).
  3. How to enter
    1. The competition will run from [3pm] on [19/02/2018] (the "Opening Date") to [19/03/2018] on [3pm] (the "Closing Date") inclusive.
    2. All competition entries must be received by Pirate by no later than [3pm] on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
    3. To enter the competition:
      1. enter the competition online by creating an online account with Pirate (or using your existing Pirate account) and submitting the online entry form provided on https://www.piratestudios.co.uk/prodigy by the Closing Date; or
      2. email your Submitted Song Link or Song File and Act Name to us at [prodigy@piratestudios.co.uk] by the Closing Date.
    4. There is no charge to register for use of the website.
    5. Pirate will not accept:
      1. responsibility for competition entries that are lost, mislaid, damaged or delayed, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of transmission as proof of receipt of entry to the competition.
    6. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

    8. The competition entries will be judged by a panel of judges based on:
      1. Quality of the song
      2. Potential commercial viability in relation to publishing and radio play
      3. Fit with Pirate Studios LTD brand
    9. The decision of the panel of judges (acting reasonably) will be final.
    10. A list of names of the judges can be viewed on https://www.piratestudios.co.uk/prodigy from the Opening Date.
  4. Eligibility
    1. The competition is only open to all residents in the UK aged 16 years or over, except:
      1. employees of Pirate or its holding or subsidiary companies;
      2. employees of agents or suppliers of Pirate or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
      3. members of the immediate families or households of (a) and (b) above.
    2. In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. Pirate may require you to provide proof that you are eligible to enter the competition.
    3. Pirate will not accept competition entries or Submitted Songs that are:
      1. automatically generated by computer;
      2. completed by third parties or in bulk;
      3. illegible, have been altered, reconstructed, forged or tampered with;
      4. not originals or infringe third party rights; or
      5. incomplete.
    4. There is a limit of one entry to the competition per person (artist or group).
    5. Pirate reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition, if you have supplied untruthful, inaccurate or misleading personal details and/or information, and/or are in breach of these terms and conditions.
    6. If you are applying on behalf of a group please ensure that you have the consent of all members of the group.
    7. Competition entries and Submitted Songs cannot be returned.
  5. The prize
    1. The prize consists of at least one, one hour, one-to-one mentoring session in each of the following areas:
      1. Marketing;
      2. Branding;
      3. Merchandising;
      4. Publishing; and
      5. Song writing.
    2. The prize will consists of:
      1. unlimited use of Pirate Studios rehearsal studios in the UK, subject to fair usage (the studios must be used only by the winner and not anyone else);
      2. the winners will receive a recording of an album written and performed by them and mixed and mastered at Pirate studios with an in-house Pirate producer, subject to fair usage (no more than 20 songs per album, max 10 minutes per song);
      3. the winners will feature on all stages that Pirate Studios secure this year at music festivals, provided Pirate Studios have curatorial control over the stage at the festival;
      4. the winners will receive a ‘Pirate Live’ headline session in 2018 meaning a live stream of a performance by the winner within one of Pirate Studios rehearsal studios on https://www.facebook.com/piratestudiosuk for a maximum of 30 minutes.
    3. All costs not expressly stated in the prize descriptions above, including but not limited to any taxes payable, food, insurance, expenses are the sole responsibility of the winners.
    4. There is no cash alternative for the prize.
    5. Pirate reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond Pirate’s control makes it necessary to do so.
    6. The prize is not negotiable or transferable.
    7. In order to claim the prize you must reply to the winning email confirming you are the prize winner.
  6. Winner announcement
    1. The winner of the competition will be announced on https://www.facebook.com/piratestudiosuk on [06/06/2018] (Announcement Date).
    2. The decision of the judges nominated by Pirate is final and no correspondence or discussion will be entered into.
    3. Pirate will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry.
    4. A list of Winners can be viewed on https://www.piratestudios.co.uk/prodigy from the Announcement Date for a period of 14 days.
  7. Claiming the prize
    1. If you are the winner of the prize, you will have 7 of days from the Announcement Date to claim the prize please refer to the details of how to claim in condition 5.6. If you do not claim the prize by this date, your claim will become invalid.
    2. The prize may not be claimed by a third party on your behalf
    3. Pirate will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 7 of days of the Announcement Date, Pirate reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
    4. Pirate does not accept any responsibility if you are not able to take up the prize.
  8. Limitation of liability
    1. Insofar as is permitted by law, Pirate, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Pirate, its agents or distributors or that of their employees. Your statutory rights are not affected.
  9. Ownership of competition entries and intellectual property rights
    1. Pirate does not claim any rights of ownership in your competition entry.
    2. You agree that Pirate may, but is not required to, make your competition entry and Submitted Song available on its website https://www.piratestudios.co.uk and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant Pirate a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and Submitted Song, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and Submitted Song for such purposes.
  10. Data protection and publicity
    1. If you are the winner of the competition, you agree that Pirate may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.
    2. You further agree to participate in any reasonable publicity required by the Pirate.
    3. By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by Pirate or its agents and suppliers to administer the competition, as well as being used to contact you by electronic means (email or SMS) with information about goods and services that we feel may be of interest to you.
  11. General
    1. If there is any reason to believe that there has been a breach of these terms and conditions, Pirate may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    2. Pirate reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
